Merck & Co., the third-largest U.S. drugmaker, slipped 2 cents to $27.64. Kenneth B. Moll & Associates Ltd., a Chicago- based law firm, filed a class action lawsuit on behalf of French consumers who may have died or suffered injuries after taking Merck's withdrawn painkiller Vioxx.

The lawsuit accuses Merck of having failed to investigate the known risks of Vioxx and to warn French consumers about potentially severe side effects, Moll said in a Business Wire statement.
