Chicago class-action lawyer Kenneth B. Moll has been appointed to the executive committee of counsel representing people who paid to view or attend the June 28, 1997, abortive title fight between Mike Tyson and Evander Holyfield.
The class-action suit naming Tyson, boxing promoter Don King and the Showtime cable TV network was certified this week by New York Supreme Court Judge Charles E. Ramos.
The suit, which arises from the infamous ear-biting incident for which Tyson was disqualified, seeks damages for authorized cable TV viewers and in-person attendees, alleging breach of contract, fraud and unjust enrichment on a third-party beneficiary theory, Moll said.
Because "it was definitely an intentional act to throw the fight," the fans "didn't get what they paid for, which is a complete fight," and Tyson should be required to disgorge profits, Moll said.
